1. Electronic files furnished by Laberge Group, pursuant to its professional services agreement or otherwise, are instruments of Laberge Groups services developed for a specific project. Laberge Group does not represent the Electronic files to be suitable for use on any other project or for any other purpose. If the Electronic files are reused without Laberge Groups written verification or adaptation, such reuse is at the reusing partys risk, without liability to Laberge Group. Any required verification or adaptation will entitle Laberge Group to further compensation at rates agreed upon by the user and Laberge Group.
2. Electronic files furnished by Laberge Group may not be reproduced or copied by anyone in any form, electronic or otherwise, without the express written permission of Laberge Group.
3. Electronic files furnished by Laberge Group may contain some or all of certain computer programs, which Laberge Group is licensed to use. Without specific written agreement by the software licensor, Laberge Group may neither transfer these program licenses to nor authorize their use by another party.
4. Laberge Group makes no warranty or guarantee, express or implied, regarding Electronic files furnished by Laberge Group or the device or medium in or on which the files are furnished. Without limiting the generality of the preceding statement, Laberge Group makes no warranties of merchantability or suitability for any use other than those contained in the agreement under which the Electronic files were developed. Laberge Group cannot and does not warrant that the electromagnetic Electronic files furnished by it will not degrade over time or contain no errors, flaws or other discrepancies that may render the Electronic files unsuitable for the purposes intended by the user.
5. Laberge Group makes no representation, warranty or guarantee that the device or medium in or on which the Electronic files are furnished is suitable for use in or on, or will not otherwise damage or impair, the users computer or other device or machine employed by the user to manipulate or otherwise use the Electronic files.
6. Any unauthorized modification or reuse of the material shall be at your sole risk and you agree to defend, indemnify and hold Laberge Group harmless from all claims, injuries, damages, losses, expenses and attorney fees arising out of the unauthorized modification or use of these materials. If there are any discrepancies between the information on these disks and the sealed hard copy of the contract drawings, the sealed hard copy of the contract drawings will prevail.
7. Use of Coordinate data contained in the electronic file is at the users sole risk and is not intended to be used for detailed stake out.
